Administrative Sanctions
Administrative Sanctions
Warning

Actions taken when the degree of violation is minor or corrective measures have already been taken.

Corrective order

These are general corrective orders that consist specifically of suspension order and announcement order for the act of violation.

Recommendation for corrective action

It has the same effect as the corrective order but the administrative sanction can be replaced with a recommendation for corrective action if the case meets given requirements (e.g. when there is no time to make corrective actions or when the violator has expressed his/her willingness to make corrective actions immediately).

Announcement order for the act of violation

This order is imposed together with the corrective order, to announce the violation of the Fair Trade Act in newspapers or to the counterparty.

Penalty payment order

A penalty may be imposed on top of the corrective actions as needed.
Penalties may be imposed within 2% of the standard sales for general unfair trade practices (3% for market-dominant business operators), and within 5% for unfair joint actions.

Others

An acquittal is made when the act is not recognized as a violation of the law or there is no evidence of the violation, while a caution is advised when necessary, such as to prevent future violations of the law even if he/she has not violated the law.
